Identify All Patent Filing Deadlines for your Patent Strategy – Steve Sponseller
On this episode of the Tech Leader Talk podcast, I’m continuing the discussion of my 7-Step system that’s helped dozens of tech companies build robust patent strategies. Today I will be discussing the second step in that system, which is critical to be sure you don’t accidentally forfeit your patent rights.
The second step to building a robust patent strategy is identifying all patent filing deadlines. Certain activities trigger a 12 month patent filing deadline in the United States. If you miss this deadline, you will likely forfeit your right to patent an invention.
Example activities that trigger the 12 month patent filing deadline in the United States:
- Public disclosure of an invention. This includes publishing documents (e.g., white papers), public announcements at a trade show or other event, publishing videos, and any other public activity that describes an invention.
- Sale of a product that contains the invention.
- An offer to sell a product that contains the invention.
